Certification introduction

 

UKCA is the abbreviation of UK Conformity Assessed. On February 2, 2019, the British government announced that it would adopt the UKCA logo scheme in the event of a no-deal Brexit. After March 29, trade with the UK will be carried out in accordance with the rules of the World Trade Organization (WTO). Like the CE logo, the UKCA logo is responsible for ensuring that the product complies with the standards stipulated in the law, and after making self-declaration in accordance with the prescribed procedures, the product will be marked accordingly.
Most products currently within the scope of CE mark control must be exported to the UK market (England, Wales and Scotland) in the future. The UKCA mark is not suitable for products entering Northern Ireland.

Certification background

 

The UK is currently in the midst of a Brexit transition period, which will end by the end of 2020. On September 1, 2020, the UK Department of Commerce, Energy and Industrial Strategy officially announced on its official website that the UKCA logo will be used from January 1, 2021.

At present, most of the products covered by the CE logo will also fall within the scope of use of the UKCA logo. It will also be suitable for aerosol products.
Starting from January 1, 2021, those products that require CE markings in the EU market will need to have UKCA markings, manufacturer's compliance statements and complete technical documents for compliance assessments entering the UK market. UKCA Statement of Conformity The requirements of DoC are also equivalent to the declaration of conformity identified by the EU CE, but the corresponding UK BS standard must be used on the DoC and the compliance with UK regulations.
As a transitional period, products with the same technical requirements and identification rules for UK and EU will still be accepted until January 1, 2022. However, if the CE marking rules for the product are changed during this period, the CE markings made under the new EU rules will not be accepted by the UK market. Therefore, it is recommended to transition to the use of the UKCA logo as soon as possible.

UKCA marking usage issues

 

If a mandatory third-party compliance assessment has been conducted by an EU-approved conformity assessment, or a certificate of conformity issued by a UK agency has been moved to an EU-approved conformity assessment, the manufacturer can still use the CE logo to sell products on the UK market. If the UK notified body was originally used and the compliance assessment file was not transferred to the EU notified body before January 1, 2021, the UKCA logo must be used immediately from January 1, 2021 and the CE logo will no longer be accepted.
Products that have been produced and put on the market before December 31, 2020 can still be sold in the UK market using the existing CE logo.
The UKCA logo will not be recognized in the EU market. Products that currently require the CE logo still need the CE logo to be sold in the EU.
Products deemed to be within the scope of mandatory regulatory controls to enter the UK market, they must have the UK Conformity Assessment (UKCA) mark after December 31, 2020 and must contact third-party institutions recognized in the UK.
Before January 1, 2023, except for products that apply special rules, the UKCA logo and related importer and manufacturer information can be marked on the product body or on the accompanying product documents. After January 1, 2023, it can only be marked on the product body.

UK Statement of Conformity

 

The UK Statement of Conformity is a document that must be drafted for most products that are legally bearing the UKCA logo.

In the document, you, as the manufacturer or your authorized representative (permitted by relevant legislation) shall:

  • Declare the product to comply with relevant statutory requirements applicable to a specific product

  • Make sure the document contains the name and address of the manufacturer (or your authorized representative), as well as information about the product and conformity assessment agency (if relevant)

A UK statement of conformity is provided to the market supervisory authority upon request.

The information required for the declaration of conformity will be substantially the same as the information currently required by the EU declaration of conformity. This may vary by application regulations, but should usually include:

  • Your name and full business address or the name and full business address of your authorized representative

  • Product serial number, model or type identification

  • Statement, stating that you are fully responsible for the compliance of the product

  • Details of the approved body that performs the conformity assessment procedure (if applicable)

  • Relevant regulations for product compliance

  • Your name and signature

  • Statement release date

  • Supplementary information (if applicable)
